TERMS AND CONDITIONS

Thank you for choosing Farm to Fit.  By visiting or shopping on farmtofit.com or the Farm to Fit app, using Farm to Fit services and Farm to Fit products, you agree to the following terms and conditions.  Please read them carefully.

If I place a one-time order, I understand and authorize Farm to Fit to charge the credit card I provide the applicable total for a one-time order in the amount of the total, this includes delivery charges and a one-time refundable cooler deposit. I understand and authorize the credit card I provide for this order to be charged on a weekly basis for any future orders I place on the Plan I select.

If I place a subscription order, I understand that meal plans are weekly recurring deliveries as stated during the ordering process and on the Frequently Asked Questions and Terms & Conditions pages of farmtofit.com. I understand that Subscription plans will automatically select meals for me based on the number of breakfasts, lunches and dinners I select in my first order. The order will automatically renew every week until I cancel my service. I understand and authorize Farm to Fit to charge the credit card I provide for each delivery I receive. I understand and authorize the credit card I provide to be charged the applicable total for my order prior to my initial meal delivery, and once per week thereafter prior to delivery. I understand if I skip, pause, or cancel my subscription before the deadline, my card will not be charged. 

Customization of Meal Plans: I understand and agree that while I can request customizations to my meals beyond the options provided on farmtofit.com, not all customization requests can be accommodated. Farm to Fit can accommodate requests to omit up to four ingredients (with some restrictions) of my choosing however I understand that requesting any modification to my meal plan can result in duplicate meals with every delivery.  I further understand that certain ingredients cannot be excluded from my meal plan. Ingredients include, but are not limited to: Onion, garlic, and carrot. I understand refunds will not be issued for the reason of an incorrect/ inaccurate delivery if I request to remove any of the aforementioned ingredients from my meal plan.  Farm to Fit reserves the right to change the list of ingredients which cannot be omitted from meal plans at any time without prior warning.

Shipping/Deliveries: I understand and acknowledge that my order with Farm to Fit will be delivered to me via Farm to Fit directly.  Although, another 3rd party courier may be used at times, at the discretion of Farm to Fit and without prior notification.  All orders are delivered with no signature required. Additionally, I understand that orders will be left at my front door, or another designated location.  If the designated location is inaccessible, the cooler will be left in an accessible location within the vicinity. I understand that meals are to be refrigerated within 4 hours of delivery, and I am responsible for the freshness and safety of the meals, once they are delivered. Delivery locations can be altered upon specific request to Farm to Fit customer service before the delivery leaves the premises. In the event of an order processing or delivery delay, my order may be delivered at a different time and Farm to Fit will notify you of any delays, when possible. 

Meal Plan Cancellation/ Pauses & Modifications: Meal Plan Subscriptions are a weekly automatically recurring service without any obligation to continue past the first two deliveries. “Meal Plans” can be canceled, temporarily paused or modified at any time prior to the relevant delivery’s cancellation/adjustment deadline.  Requests received by Tuesday at 3:00pm PT can be applied to the following Sunday’s delivery. Requests received by Friday at 3:00pm PT can be applied to the following Wednesday’s delivery. However, if a request to cancel, suspend, or modify a Meal Plan is received after the set deadlines, the current Meal Plan order will be processed without change and any modifications requested will take effect with the following order’s delivery.

Dietary Restrictions and Allergies: Farm to Fit makes every effort to accommodate allergies identified in your order. Farm to Fit produces all meals in a commercial kitchen, for this reason, there is always a chance of cross contamination or even human error.  If you have questions about the ingredients in the meal you received, please contact us immediately prior to eating or opening the meal contents.  In addition, consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness, especially if you have a medical condition.

Physician’s Approval: Farm to Fit recommends consulting with a physician before beginning any new diet.

Billing: When you place a One Time Order, you are charged once at the time of your order, for the items you have selected for your first delivery period of one week. Your billing information will be kept on file and billed for future orders you place on the plan.

When you first sign up for a Subscription, you are charged for the first week of the Plan at the time of your order. All Plans are continuous subscription plans, and you will be charged the applicable price for the Plan that you select on a weekly basis. If you wish to cancel or modify your subscription you can do so at any time on farmtofit.com or by contacting our customer service team. Except as otherwise noted below, any amounts charged to or paid by you prior to such cancellation or modification will not be refunded, and cancellations or modifications may not impact any order for which you have already been charged, depending on the status of the order.

Farm to Fit may change the price of a Plan, introduce new Plans, or remove Plans from time to time, and will communicate any price or Plan changes to you in advance by email within fourteen (14) or more days of notice. By continuing to use the Farm to Fit Service after the effective date of a price or Plan change, you indicate your acceptance of such price or Plan change. If you do not agree with a price or Plan change, you have the right to reject the change by canceling your subscription(s) prior to the effective date of the price or Plan change. Please make sure that you read any notifications of price or Plan changes carefully.

Applicable sales tax may be charged on your order based on local and state laws.

You are fully responsible for all activities that occur under your account, and you agree to be personally liable for all charges incurred under your account based on your delivery status as of the specified deadline. Your liability for such charges shall continue after termination of this Agreement.

Returns: All sales are final. I understand that any meals or other products purchased through/from Farm to Fit online or over the phone, are perishable food items and can not be returned to the sender for a refund. If you choose to cancel an order within 24 hours of placing the initial order, Farm to Fit will process a refund to your account for the full amount minus a 5% processing fee.

Cooler Deposits: At the time of initial purchase, you will be charged a one-time refundable cooler deposit as broken down as a line item in the order summary page of the order process. This deposit is refundable upon return of your final cooler. 

After your final delivery, if you do not leave a personal cooler out for us to exchange the meals into (this is recommended), it is your responsibility to return your cooler to us at 5411 NE Lombard St. within 60 days. If you would rather us pick up your final cooler at your home or office, we are happy to do so for your current delivery fee. Just email or call us to arrange this. If we have not received your cooler bag(s) within 60 days of your last delivery, pick up or drop off of meals your cooler deposit will be forfeited.

Promotions and Discount Codes: If I subscribe to a weekly meal plan or a one-time order using a discount code, I understand that it is my responsibility to read the terms and conditions of the promotion as advertised.

Canceling a meal plan subscription will result in the loss/ forfeiture of ongoing promotional gifts and discounts granted at the time of sign up for said meal plan. Customers may pause deliveries for up to three (3) consecutive weeks and retain discounts/ promotional offers, however, pauses beyond three (3) consecutive weeks constitute a meal plan cancellation. 

Communication: I understand when I place an order on the website or through the app, I agree to receive emails and text messages including communication relating to my order or delivery and promotional messages. I understand that I can opt-out of these communications at any time. Farm to Fit advises to keep transactional emails active in order to successfully manage your account. 

Policy Changes: Farm to Fit reserves the right to modify or delete our terms and conditions at any time. Any such changes do not nullify our rights if infringements or breaches occurred under a previous version of these conditions.

Governing Law: By visiting www.farmtofit.com, you agree that the laws of the state of Oregon, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and Farm to Fit.

Indemnification: You agree to indemnify, defend, and hold Farm to Fit, its officers, directors, employees, agents, licensors, suppliers, subsidiaries, and affiliates harmless from and against any claims, actions, demands, damages, awards, judgments, liabilities, and settlements including, without limitation, reasonable legal fees, expenses, and costs resulting from, or alleged to result from your violation of these Terms and Conditions, or any use by you of this website in any manner other than as expressly authorized in these Terms and Conditions.

Gift Cards

In order to purchase a Gift Certificate, you will need to register an account with us through our Website.  Gift Cards ordered through our Website will be delivered automatically by electronic means to the email address you specify at the time of order.  You may also choose for Farm to Fit to mail a physical Gift Card to your recipient. Virtual Gift cards have no expiration date, physical gift certificates expire within one year of the date of issue, in accordance with Oregon state law. Our Gift Card must be redeemed on our Website, as full or partial payment of products from our Website.  A Gift Certificate cannot be used to purchase another Gift Certificate.  When ordering a Gift Certificate, you should ensure to enter the recipient’s email address correctly.  We cannot be held responsible if the address is entered incorrectly and someone other than the intended recipient uses the Gift Certificate.  Site offers and promotions (including gifts with purchase and discounts) do not apply when purchasing gift cards.  If any refund is to be required regarding a gift card charge, it will be returned in the form of store credit only.Gift cards are non-refundable, but may be transferred to another recipient by contacting the office. We are not responsible if a Gift Certificate is lost, stolen, destroyed or used without permission and no replacement will be provided in these circumstances.

These Terms and Agreement and our Privacy Policy constitute the sole and entire agreement between you and Farm to Fit with respect to www.farmtofit.com, any subsidiary or affiliated site(s), and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties.
